Chicago’s Fraternal Order of Police (FOP) is asking for a federal investigation into whether Kim Foxx, the Cook County State’s Attorney, tried to interfere into the department’s investigation of “Empire” star Jussie Smollett on behalf of a former Obama administration official. Are you kidding me?
According to CWB Chicago, Chicago’s police union requested the investigation in a letter to John R. Lausch, the U.S. Attorney in Chicago on Monday.

Smollett is accused of staging a “hate crime” outside his Chicago apartment in the early morning hours of January 29, 2019. Smollett claimed to have been assaulted by two white men who beat him, tied a noose around his neck, and splashed him with bleach, before yelling “This is MAGA country” and running off. After an intense investigation involving at least a dozen Chicago Police Department officers, CPD announced that they believed Smollett orchestrated the attack with the help of two friends, brothers he’d met on the set of his hit television show.
Smollett was charged with “disorderly conduct,” but only after Cook County State’s Attorney Kim Foxx recused herself for reasons that went unspecified until last week.
“[Cook County State’s Attorney Kim] Foxx recused herself late in the investigation, but only after she intervened in the case by asking Chicago Police Department Superintendent Eddie Johnson to turn the investigation over to the FBI at the request of a Smollett relative and a former Obama administration official, according to newly-released emails and text messages,” CWB Chicago reported.
It never made any sense that there was talk about handing the case over to the federal government. In fact, the only thing that made sense about it is that with the knowledge of how corrupted the deep state became under Obama, the Obama people probably have some folks still inside the DOJ who would go easy on Smollett the same way they went easy on another criminal, Obama’s former Secretary of State Hillary Clinton.
Foxx corresponded with Tina Tchen, a lawyer and former chief of staff to First Lady Michelle Obama who also worked as an aide to President Obama himself. A series of emails and text messages were obtained by the Chicago NBC affiliate.
Inside the correspondence, Tchen told Foxx that Smollett’s family “have concerns about the investigation” of two white Trump supporters who attacked Smollett outside his Chicago apartment building in January. Foxx replied that she “spoke to the superintendent” and was “trying to figure out logistics,” and later revealed that she thought she convinced Johnson “to reach out to FBI to ask that they take over the investigation.” So, the Smollett family was worried about local police looking into Jussie’s crimes and wanted the feds to take over.
A relative of Smollett said in the text messages, “OMG this would be a huge victory.” To them, it’s about helping Jussie get away with his crimes. Personally, I think what Smollett did the lowest of the low. He smeared over 60 million Trump voters and created more tension between the races. He is a piece of garbage who deserves everything he gets from the justice system.
Fortunately, Johnson is a man of integrity and didn’t turn the case over to the federal government. Foxx eventually recused herself, and a deputy state’s attorney issued an official charge of “disorderly conduct” against Smollett for allegedly filing a false police report, the fallout of which was more serious than the false report. Last week, a grand jury added 16 more felony counts to the state’s attorney’s charge.
The feds are involved, though. The U.S. Postal Inspector is investigating mail fraud since Smollett used the postal system to deliver the alleged threatening letter to the “Empire” studios.
The FOP president wrote in a letter to the U.S. Attorney that “private attorneys [like Tchen] are not allowed to interfere with ongoing police investigations, particularly at the request of private individuals associated with subjects being investigated by the police.” Will they look the other way, as everyone reading this believes?
He also wrote that Foxx’s last-minute recusal from the case was insufficient to avoid a conflict of interest and to correct Foxx’s inappropriate involvement. In other words, Foxx only recused herself when she realized her interference wasn’t going to help, so she tried to appear on the up and up, and has failed miserably. She needs to be dealt with.
“In order for Ms. Foxx to properly charge and try this case, her entire office should have recused itself and a special prosecutor been appointed,” the letter read.
I want to stress that I was a huge fan of Jussie Smollett. I watched “Empire” until it went all Black Lives Matter on America, but even though I stopped watching the show I admired the young actor/singer, so it was a sad revelation to me when I heard what he did.
